GradSift Terms & Conditions
Please read these terms & conditions and our privacy policy carefully before accessing or using the information and services available through the GRADSIFT website (herein referred to as “the Site”). By accessing or using the Site, you agree to be bound by the terms and conditions below and our Cookies and Privacy Policies. GRADSIFT may modify this agreement at any time and such modifications shall be effective immediately upon posting the modified agreement on the Site. Individuals who register to use the Site as registered clients are herein referred to as Clients.
As an individual to create an account, you must be:
- At least 16 years of age (or, if you are under 16 years of age, you must have permission from your parent or legal guardian to create an account);
- Possess the legal right and ability to enter into a legally binding agreement with us; and
- Agree and warrant to use the Site in accordance with these Terms.
Individuals who register as Candidates/Applicants/Students/Graduates of GRADSIFT or GRADSIFT EXTRA are herein referred to as Applicants.
Clients and Applicants are solely responsible for the accuracy and truthfulness of information provided to GRADSIFT. Applicants acknowledge and agree to provide Clients and users of the Site access to information the Applicant provides to GRADSIFT. GRADSIFT uses its best endeavors to ensure that a Client uses Applicant data solely for the purpose of considering employment and that data is used, stored, and processed in accordance with the guidelines of the GDPR and the CalOPPA.
The Applicant is fully responsible for the information uploaded. GRADSIFT is not responsible for inappropriate dealings or behavior by GRADSIFT Clients or users of the Site including but not limited to spamming, solicitation, marketing, data harvesting and use of Applicant information. As GRADSIFT becomes aware of inappropriate dealings or behavior by GRADSIFT clients, GRADSIFT will take action to remove them.
Clients agree to use Applicant information contained on the site solely for the purpose of considering Applicants for employment opportunities. Clients agree not to spam, solicit, market to Applicants, harvest Applicant data or use Applicant information inappropriately or without Applicant consent.
You agree that information contained on this Site is for personal use only and may not be sold, redistributed or used for any commercial purpose. You acknowledge and agree that information published by GRADSIFT is intended to provide general information in summary form on legal and other issues. GRADSIFT does not endorse or recommend any of the Clients or any of the Client opportunities presented to Applicants. GRADSIFT does not endorse or recommend any of the Applicants and Clients must rely solely on their own assessment of Applicants for their suitability, skills, experience, integrity, qualifications and capability to perform. GRADSIFT strongly recommends that prior to entering into any agreement with any Client or Applicant, that you obtain your own independent legal, accounting, financial or taxation advice as appropriate. It is solely your responsibility to evaluate the accuracy, risk, completeness and usefulness of all services, opinions, advice, information, assignments and arrangements offered by Clients or Applicants. In no event will GRADSIFT be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the site or from any arrangement entered into between a Client and Applicant. Applicants can remove their profile and personal details at any time by logging into their GradSift account. Clients can delete their account at any time by emailing support@gradsift.com.
Clients agree that GRADSIFT may use the name of their organization in general communications. GRADSIFT will not sell, trade, give or rent any personally identifiable information obtained from you to a third party unless you consent. It is GRADSIFT's policy to retain the minimum personal information required in order to facilitate connections between Applicants and Clients. From time to time GRADSIFT may provide Applicants with selected information about relevant Clients via email or text communication. This includes an opt-out function. GRADSIFT takes all reasonable steps to ensure the security of our system and allows you to access your information at any time to keep it accurate and up to date. Any information, which we hold for you is stored on servers that are protected in controlled facilities, which are located in Australia. GRADSIFT will not be held responsible for events arising from unauthorized access of your personal information. GRADSIFT takes all action to comply privacy guidelines and legislation. GRADSIFT has a Data Breach Response Plan to report eligible data breaches to authorities, applicants and members of the public if it believes or is aware that data has been compromised.
GRADSIFT provides links to Internet sites maintained by third parties. GRADSIFT is not responsible for the contents of any linked site or any link contained in a linked site. GRADSIFT is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by GRADSIFT of the linked site. GRADSIFT is not responsible for the copyright compliance of any linked site. GRADSIFT will not be liable for any damages or loss arising in any way out of or in connection with or incidental to any information or third party. GRADSIFT provides no warranty to you that the services generally available through its Site will be uninterrupted or error-free or that defects in the service will be corrected. GRADSIFT cannot and does not guarantee or warrant that files available for downloading through the Site or delivered via electronic mail through the Site will be free of malware code that manifest contaminating or destructive properties. While GRADSIFT takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on GRADSIFT systems or on GRADSIFT's Site. GRADSIFT disclaims all liability to you to the greatest extent possible pursuant to law should this occur.
To become a registered user, you must provide a password and an email login name. You are entirely responsible if you do not maintain the confidentiality of your password and login name. Furthermore, you are entirely responsible for any and all activities that occur under your login name. You may change your password at any time by following instructions. You may also change your login or delete services by contacting support@gradsift.com. You agree to immediately notify GRADSIFT of any unauthorized use of your login name or any other breach of security known to you.
Copyright in the material and trademarks on this Site are owned by Starforce International Pty Ltd Limited ABN 28 108 499 029, an Australian registered company trading as GradSift unless otherwise indicated and you agree not to infringe any intellectual property rights owned by GRADSIFT. If any part of this agreement is held invalid that part shall be severed from this agreement and the remainder of this agreement will continue to be valid and enforceable. Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement. The laws governing this agreement will be the laws in New South Wales, Australia and you irrevocably submit to the exclusive jurisdiction of its Courts and its Appellate Courts and the jurisdiction of the Federal Court of Australia sitting in New South Wales.
